Almost every “Dubai freehold areas” list you will read is an unsourced summary of a legal instrument that works by land plot and map, not by community name. This guide goes to the instrument itself: what Regulation No. 3 of 2006 actually designates, how it has been amended, and the only reliable way to confirm the tenure of a specific property.

Where Dubai’s Freehold Rights Actually Come From

Foreign freehold ownership in Dubai rests on a single named instrument: Regulation No. (3) of 2006 Determining Areas for Ownership by Non-UAE Nationals of Real Property in the Emirate of Dubai, issued by HH Sheikh Mohammed bin Rashid Al Maktoum, Ruler of Dubai, on 7 June 2006 and effective on publication in the Official Gazette.

Article 3 is the operative provision. It states that non-UAE nationals may acquire freehold ownership rights over real property without time restriction, usufruct rights, or leasehold rights for up to ninety-nine (99) years, in respect of the land plots indicated opposite each of the listed areas as shown by the maps issued by the Department and attached to the Regulation.

That last clause is the part every summary drops, and it is the part that matters. The right is not granted to a community, a master development or a brand name. It is granted to land plots, identified on maps. A community name is a convenient label sitting on top of a plot-level designation, and the two do not always align.

The Regulation proves this itself. Article 4 carves out a single plot: Land Plot 224 in Nad al-Sheba is restricted to usufruct or a 99-year leasehold, and not freehold, even though Nad al-Sheba appears in the Article 3 schedule. If the instrument that created the regime needs a plot-level exception on its own first page, a list of 60-odd community names cannot be a safe basis for a purchase.

Why No Two Freehold Lists Agree

This is not carelessness by the people writing them. It follows from how the designation is built, and it is worth understanding before you trust any list — including ours.

Amended

The schedule is a living instrument

Resolution No. (6) of 2022, issued on 28 February 2022, provides that a non-UAE national may acquire freehold ownership rights, without time restriction, in the land and real property units on Land Plots No. (58) and (59) in Zabeel First. It cites Regulation No. 3 of 2006 and its amendments as its authority. Additions like this are published one at a time, not as a refreshed master list.

By Plot

Not by community name

Article 3 grants rights over the land plots indicated on maps issued by the Department. Article 4 then restricts a single plot — Nad al-Sheba 224 — to usufruct or a 99-year leasehold. One marketing community name can therefore cover plots whose tenure differs, which no name-based list can express.

By Emirate

The rules are not federal

The UAE Government’s official platform sets out that Abu Dhabi uses four separate arrangements under Law No. 19 of 2005, and that in Sharjah non-nationals hold usufruct rights only, for a maximum of 100 years and with the Ruler’s special approval. “UAE freehold” is not a single regime.

What this means in practice. Use the Article 3 schedule to understand the shape of the regime, and use the property itself to answer the question you actually care about. For a completed unit, the title deed states the tenure and identifies the plot. For an off-plan unit, get the tenure confirmed in the sale contract before any money moves, and remember that a resale is documented on Form F and completed at a registration trustee office, where the deed is issued. Which areas in Dubai are freehold for foreigners?+
Freehold designation in Dubai comes from Regulation No. (3) of 2006 Determining Areas for Ownership by Non-UAE Nationals of Real Property in the Emirate of Dubai. What rights can a non-UAE national actually acquire?+
Article 3 of Regulation No. (3) of 2006 provides that non-UAE nationals may acquire freehold ownership rights over real property without time restriction, usufruct rights, or leasehold rights for up to ninety-nine (99) years, in respect of the land plots indicated opposite each listed area on the maps issued by the Department. The three are not interchangeable. Freehold without time restriction is ownership. Usufruct is a right to use and enjoy the property without being able to alter it. A 99-year leasehold is a long lease that expires. Which of the three applies to a given plot is a question about that plot, and the answer belongs on the title deed.
Has the list of Dubai freehold areas changed since 2006?+
Yes. The schedule is amended by resolution, and those resolutions are published individually rather than as a single refreshed list. A documented example is Resolution No. (6) of 2022, issued by HH Sheikh Mohammed bin Rashid Al Maktoum on 28 February 2022, which provides that a non-UAE national may acquire freehold ownership rights, without time restriction, in the land and real property units existing on Land Plots No. (58) and (59) in Zabeel First. That resolution cites Regulation No. (3) of 2006 and its amendments as its authority, which confirms the 2006 schedule is a living instrument. This is why published community lists on property websites often disagree with one another.
Why do freehold area lists on different websites contradict each other?+
Because they are secondary summaries of a plot-level legal instrument that is amended piecemeal. Three things cause the divergence. First, the schedule has been expanded by separate resolutions since 2006, and not every list tracks every one. Second, designation attaches to land plots shown on maps issued by the Dubai Land Department, so a single marketing community name can contain plots with different statuses. Third, the Regulation itself contains a plot-level carve-out: Article 4 restricts Nad al-Sheba plot 224 to usufruct or a 99-year leasehold rather than freehold. A list of community names simply cannot express that level of detail, which is why no list should be relied on for a purchase decision.
How do I confirm whether a specific Dubai property is freehold?+
Work from the property, not from a list. The title deed issued by the Dubai Land Department states the tenure and identifies the plot, so that document is the answer for a completed property. Ask for the plot number and check the tenure against it rather than against the community name used in marketing. Dubai Land Department records, including those accessible through the Dubai REST app, let you verify what you have been told. For an off-plan purchase the tenure should be confirmed in the sale contract before you sign, and the transfer itself is completed at a registration trustee office where the deed is issued. Can foreigners buy freehold property anywhere else in the UAE?+
The rules differ by emirate, and Dubai is the most liberal. The UAE Government’s official platform sets out that in Abu Dhabi, foreign nationals may use four arrangements under Law No. 19 of 2005 Concerning the Regulation of the Real Estate Sector: ownership for 99 years allowing them to fully dispose of the apartments and villas they buy with land not included, musataha for 50 years renewable by agreement of the parties for a similar period, usufruct for 99 years entitling the holder to use the property without being able to change it, and a long-term lease of not less than 25 years. It names nine designated investment areas in Abu Dhabi: Yas Island, Saadiyat, Reem, Mariya, Lulu, Al Raha Beach, Sayh Al Sedairah, Al Reef and Masdar City. In Sharjah, the same platform states that non-nationals have usufruct rights only, for a maximum of 100 years, and that special approval from the Ruler of Sharjah is required.
