A Dubai property transfer is completed in person at a Real Estate Registration Trustee centre. If you cannot be there, someone has to attend for you — and the document that lets them do it is the part of the deal most likely to delay it. Here is what a property power of attorney must contain, the legalisation chain for one signed abroad, the digital route inside the UAE, and how to keep the authority you hand over narrow.

The Basics

Why a Power of Attorney Sits at the Centre of a Remote Deal

A power of attorney is a document by which one person, the principal, authorises another, the attorney, to act on their behalf. In Dubai property it is not an exotic instrument. It is the ordinary mechanism by which overseas investors buy, by which owners who have left the UAE sell, and by which a spouse, a relative or an appointed representative signs a transfer that the owner cannot attend in person.

It matters because of how a Dubai transfer actually completes. The Dubai Land Department lists the service channel for property sale registration as a Real Estate Registration Trustee centre — a physical office where the parties attend, identity is verified and the transfer is registered. The Land Department’s own requirement is the Emirates ID of both seller and buyer for identity verification, or a valid passport for non-resident foreigners. Somebody has to be in that room. If it is not you, it has to be an attorney holding a document the Trustee will accept.

That last clause is where deals slip. A power of attorney that is valid and perfectly ordinary in London, Mumbai or Johannesburg is not automatically recognised in the UAE. It has to be executed and authenticated in a way the UAE recognises, and it has to be readable by the authority relying on it, which means Arabic, or a certified Arabic translation. Buyers routinely budget weeks for financing and days for the power of attorney, when in practice it is often the other way round.

The second thing to understand is scope. A power of attorney is not a formality to be signed as broadly as possible so that it covers every eventuality. It is a transfer of authority over an asset, and the sensible instinct is the opposite one: grant the narrowest authority that gets the transaction done. Three Ways a Property POA Goes Wrong

Almost every problem with a property power of attorney traces back to one of these three. All are avoidable at drafting stage and expensive afterwards.

Too Broad

Authority beyond the deal

A general power drafted to cover everything hands an attorney the ability to act on matters you never contemplated. Restrict it to one property, one transaction and a defined set of acts. If the attorney does not need to receive the sale proceeds, say so expressly rather than leaving it unaddressed.

Too Vague

The property is not identified

A power that authorises the sale of “my property in Dubai” invites rejection. Identify the unit by its registration details and name the transaction in terms the registry uses — sell, purchase, mortgage, gift, lease or manage — rather than in general language that leaves the authority open to interpretation.

Open-Ended

No expiry, no revocation plan

A power with no end date survives the transaction it was created for. Set an expiry. And understand before you sign that revoking one is not a phone call: it has to be formally executed and notified to everyone holding or relying on the document, including the Land Department and any bank.

The practical sequence: decide the transaction first, then draft the power around it. Establish who your attorney will be and confirm they are willing and available to attend a Trustee centre. Get the wording reviewed by someone who knows what the registry accepts before you notarise, because every correction after notarisation means running the whole legalisation chain again. Allow for the Arabic translation. Then, once the transaction has completed, close the loop: confirm the title has been registered in the correct name, obtain the title deed, and revoke the power if it has any life left in it. A power of attorney is a tool for a single job, and it should be retired when that job is finished. Can I buy or sell property in Dubai without being in the UAE?+
Yes, provided you appoint someone under a properly executed power of attorney. Dubai property transfers are completed in person at a Real Estate Registration Trustee centre, so if you cannot attend, an attorney must attend on your behalf. The power of attorney has to be valid in the UAE, which means it must either be notarised inside the UAE or, if you sign it abroad, be notarised in your country and then put through the full legalisation chain before it is recognised. Buying remotely is routine in Dubai, but it is the power of attorney rather than the purchase itself that usually determines the timeline.
What is the difference between a general and a special power of attorney?+
A general power of attorney grants broad authority across a range of matters. A special or specific power of attorney grants defined authority for a defined purpose. For property you should use a special power of attorney limited to the specific property and the specific transaction. It should identify the property by its registration details, state exactly which transaction is authorised, whether that is to sell, to purchase, to mortgage, to gift, to lease or to manage, and it should say whether the attorney may sign the transfer at the Trustee centre and whether they may receive sale proceeds. A broad general power drafted for something else is frequently rejected, and even when accepted it hands over far more authority than a single transaction requires.
How do I legalise a power of attorney signed outside the UAE?+
A power of attorney executed abroad goes through a chain rather than a single step. You sign it before a competent notarial authority in your country of residence. It is then legalised by the authority that certifies notarial acts in that country, typically the ministry of foreign affairs. It is then attested by the UAE embassy or consulate in that country. Once it reaches the UAE it is attested by the Ministry of Foreign Affairs, and it must be in Arabic or accompanied by a certified Arabic translation. The UAE Ministry of Foreign Affairs offers attestation through selected UAE missions abroad and advises checking the website of the UAE mission in your country of residence to confirm whether the service is available electronically. Can a power of attorney for Dubai property be issued digitally?+
There is a digital route for powers of attorney issued inside the UAE. The UAE Ministry of Justice operates a Digital Power of Attorney Issuance Service through its platform at moj.gov.ae. When the Ministry announced Phase 2 of the service in June 2023 it covered eight types of power of attorney, including lawyer representation and digital powers of attorney in areas such as legal cases, real estate, rental disputes, licensing, vehicles, stocks and company management. The Ministry stated that users can generate a digitally ratified power of attorney in less than ten minutes without visiting a notary office, with documents secured through blockchain and a digital wallet so they can be stored and shared with authorised parties.
What does the property transfer itself cost at the Trustee centre?+
The Dubai Land Department publishes the fee schedule for property sale registration. Registration fees are 2 per cent of the sale value payable by the seller and 2 per cent payable by the buyer. On top of that are title deed certificate issuance at AED 250, the Dubai Municipality unified map at AED 225, a map for lands outside Dubai Municipality at AED 100, villas and apartments at AED 250, a knowledge fee of AED 10 and an innovation fee of AED 10. Service partner fees are AED 4,000 plus VAT where the sale value is AED 500,000 or more, and AED 2,000 plus VAT below that. The Dubai Land Department also lists a no-objection e-certificate from the developer, obtained through the Dubai REST app, as a required document in freehold areas. These fees are payable whether you attend yourself or an attorney attends for you.
How do I cancel a power of attorney in Dubai?+
A power of attorney can be revoked by the person who granted it. Revocation is not simply a matter of telling your attorney to stop. You should have the revocation notarised in the same way the original was executed, notify the attorney formally, and notify every institution that holds or relies on the document, which in a property matter means the Dubai Land Department and any bank involved. Until the revocation reaches the bodies that hold the original, an attorney may still be able to present it. For that reason it is far safer to limit the power at the outset than to rely on withdrawing it later: name one property, authorise one transaction, and set an expiry date rather than leaving it open-ended.
