Dubai law does not ban subletting. It bans subletting without the landlord’s written consent — and it makes that breach one of the few grounds on which a tenancy can be ended before it expires. Since 26 August 2026 a second law applies on top, bringing shared housing under a Dubai Municipality permit. Here is exactly what each rule says.

The Basics

What Dubai Law Actually Says About Subletting

Subletting is where a tenant, who holds a lease from the owner, allows someone else to occupy the property — all of it or part of it — in exchange for rent. The original tenant stays on the hook to the landlord under the head lease; the new occupier answers to the tenant. It is a common arrangement in Dubai, and it is entirely lawful when it is done properly. The trouble comes from how often it is done without the one thing the law requires.

The governing provision is Article 24 of Law No. 26 of 2007, which regulates the relationship between landlords and tenants in the Emirate of Dubai. Its wording is short and worth reading exactly as drafted: “Unless otherwise agreed by the parties to the Lease Contract, the Tenant may not assign the use of or sub-lease the Real Property to third parties unless written consent of the Landlord is obtained.”

Two things follow. The first is that the default is prohibition — if your tenancy contract says nothing about subletting, you may not sublet. The second is the opening clause, “unless otherwise agreed”, which means the lease itself can change the default. A tenancy contract that expressly permits subletting is valid, and where it does, you are not required to go back and ask again. This is why the first step is always to read the contract you already signed rather than to ask a neighbour what is customary.

The article requires written consent. A verbal assurance, a friendly WhatsApp exchange or an agent’s say-so is not what the provision calls for. If a dispute reaches the Rental Disputes Centre, the question will be whether written landlord consent exists — so it should be obtained on paper, signed and dated, and kept for the life of the tenancy.

What Changed in 2026

There Are Now Two Laws in Play, Not One

Until this year, an unauthorised sublet was a tenancy-law problem between a landlord and a tenant. Since 26 August 2026 it can also be a licensing problem with Dubai Municipality.

Existing shared housing owners and operators have one year from 26 August 2026 to bring properties into line, and the deadline may be extended once by a decision of the municipality’s director-general. That window closes in August 2027 unless extended.

It is now wrong twice over. Law No. 4 of 2026 provides that no individual or company may designate a property for shared housing without a permit, and that only property owners and licensed establishments may rent out approved units. A tenant subdividing occupancy of a leased unit is, by definition, neither the owner nor a licensed establishment. Dubai Municipality determines the maximum number of occupants, the space each resident must be given and the communal facilities required. Note also Article 19, which prevents a tenant from making changes to the property without the landlord’s permission and the required licences — the provision that partitioned rooms and added internal walls run into. Is subletting legal in Dubai?+
Subletting is legal in Dubai, but only with the landlord’s written consent. Article 24 of Law No. 26 of 2007 states that, unless otherwise agreed by the parties to the lease contract, the tenant may not assign the use of or sub-lease the property to third parties unless written consent of the landlord is obtained. Two things follow from that wording. First, the default position is that you may not sublet. Second, the default can be changed by the lease itself, so a tenancy contract that expressly permits subletting is valid and you do not need to ask again. Verbal permission is not what the article requires, so consent should be recorded in writing and kept.
What happens if I sublet without the landlord’s permission in Dubai?+
Subletting without written approval is an express ground for eviction before the tenancy expires. Article 25(1)(b) allows the landlord to seek eviction where the tenant sub-lets the property or any part of it without obtaining the landlord’s written approval, and the eviction applies to the sub-tenant as well as the tenant. The sub-tenant is not left without a remedy: the same article preserves the sub-tenant’s right to claim compensation from the tenant who sublet to them. In practice this means the person who arranged the unauthorised sublease carries the financial exposure for both parties.
Does subletting a single room count, or only the whole property?+
Article 25(1)(b) refers to sub-letting the real property or any part thereof, so letting one room falls inside the same rule as letting the entire unit. Renting out a spare bedroom without the landlord’s written approval is treated the same way in law as handing over the whole apartment. Since 26 August 2026 there is a second layer to consider as well, because sharing a home with people outside the tenancy may bring the property within Dubai’s shared housing regime under Law No. 4 of 2026, which requires a permit from Dubai Municipality.
What is Dubai’s new shared housing law and when did it take effect?+
Law No. 4 of 2026 regulates how shared housing is managed, occupied and leased in Dubai. It was published in the Official Gazette on 27 February 2026 and came into force 180 days later, on 26 August 2026. Under the law, no individual or company may designate a property for shared housing without a permit, and only property owners and licensed establishments may rent out approved units. Dubai Municipality determines the maximum number of occupants, the space each resident must be given and the communal facilities that must be available. How does a landlord evict a tenant for subletting in Dubai?+
The landlord relies on Article 25(1)(b) and must follow the notice mechanism the law prescribes. Article 25(1) requires the landlord to serve notice on the tenant through a Notary Public or by registered mail. The notice should identify the ground being relied on. If the matter is not resolved, the claim is filed at the Rental Disputes Centre, which is the dedicated judicial body for Dubai tenancy disputes. Landlords should note that the twelve-month notice period applies to the Article 25(2) grounds for eviction on expiry, such as sale or owner occupation, and is not the route used for a mid-term breach such as unauthorised subletting.
