How the Transfer Actually Works
A large share of Dubai resale stock still carries a loan. That does not make it harder to buy — it makes it a different, well-defined process. Three manager’s cheques, one liability letter, and a mortgage release that happens inside the same registration. Here is the Dubai Land Department’s own procedure, step by step.
Your Seller Still Owes the Bank. Now What?
You have agreed a price on a Dubai apartment and then the agent mentions, almost in passing, that the seller has a mortgage on it. For a lot of buyers that is the moment the deal starts to feel risky. Who pays whom, and in what order? What stops your money disappearing into somebody else’s loan while the title deed stays exactly where it was?
The reassuring answer is that this is not an edge case. It is common enough that the Dubai Land Department publishes a dedicated service for it — Registering the Sale of a Mortgaged Property — with its own document list, its own fee schedule, and its own six-step procedure. The seller’s loan is settled and the mortgage discharged inside the same registration that transfers the property to you.
The mechanism that makes it safe is the cheque structure. The DLD requires three manager’s cheques: one made out to the bank or developer, one to the seller, and one to the Department. Your money does not pass through the seller’s hands on its way to the bank. It is split at the counter, with the bank paid precisely what the liability letter says is outstanding and the seller receiving only the balance above it.
Understand that structure and the rest of the process is administrative. Misunderstand it — most dangerously, by agreeing to settle a seller’s loan privately before registration — and you are exposed in a way the official route simply does not leave you.

Where These Deals Actually Go Wrong
Not in the paperwork. In the sequencing, the timing, and one specific shortcut buyers are sometimes asked to take.
Settling the loan privately
If a seller asks you to pay off their mortgage directly before registration so the property can be sold “clean”, you are funding a stranger’s debt with no registered interest in the asset. The DLD process exists precisely so this is unnecessary. Decline it and keep the settlement inside the official registration.
A stale liability letter
The letter states a balance as at a date. Interest accrues and payments post. If the figure has moved by the time you reach the counter, the cheque is wrong and the transfer does not complete that day. Confirm the letter is current before cheques are drawn, not after.
Underestimating bank lead time
The DLD quotes 15 to 20 minutes at the counter. That is the easy part. The variable is how long the seller’s bank takes to issue the liability letter and then the release. Neither is under the Land Department’s control, and neither is under yours — so it belongs in the contract as a timeline, not an assumption.
What It Costs Over and Above a Normal Purchase
A mortgaged transfer carries every fee an ordinary transfer carries, and then a mortgage layer on top. The base is unchanged: 4% of the sale value as the registration fee, ۲۵۰ درهم for the title deed, and the AED 10 knowledge و AED 10 innovation fees that attach to Dubai government services generally.
The registrar fee follows the familiar AED 500,000 threshold, quoted on this service page VAT-inclusive: AED 2,100 where the price is under AED 500,000 and ۴٬۲۰۰ درهم where it is at or above it. Those are the same tiers the standard sale registration page states as AED 2,000 and AED 4,000 plus VAT.
The mortgage-specific additions are the ones to budget for. Discharging the seller’s existing charge costs AED 1,290 for the mortgage release procedure و AED 315 for the registrar to release the mortgage. If you are financing your own purchase rather than paying cash, registering your new mortgage costs 0.25% of the mortgage value — note that this is calculated on the loan, not on the purchase price, so a larger deposit reduces it.
What we have deliberately not put a number on: the fee your own bank charges to arrange finance, any valuation it requires, conveyancing, and agency commission. None of those are set by the Land Department, none appear on its schedule, and quoting a typical figure for them would be guesswork. Ask for each in writing before you commit.
