The relationship between landlords and tenants in the emirate is governed by <strong>Law No. 26 of 2007<\/strong>, as amended by <strong>Law No. 33 of 2008<\/strong>, and that law is unusually specific about non-payment. It does not require the tenant to be months behind, and it does not require the lease to have expired. Article 25(1) allows a landlord to seek eviction <em>before the expiry of the lease contract term<\/em> where the tenant fails to pay the rent \u2014 or any part of it \u2014 within thirty days of being served a notice to pay.<\/p>\n        <p>Two things in that sentence do most of the work. The first is <em>any part thereof<\/em>: a bounced cheque for one quarter is as much a trigger as a year of silence. The second is <em>from the date of service of Notice<\/em>. The thirty days do not start when the rent became due, when the cheque bounced, or when you first sent a reminder. They start when a notice is properly served \u2014 and the law is precise about what &#8220;properly&#8221; means. Under the amended Article 25, the landlord serves notice <strong>through a Notary Public or by registered mail<\/strong>. A WhatsApp message, an email to the tenant&#8217;s work address, or a conversation in the lobby does not start the clock, however clearly it was worded and however obviously it was received.<\/p>\n        <p>Before any of that matters, though, there is a gate you have to be through already. Article 4 requires lease contracts covered by the law to be registered with RERA \u2014 in practice, Ejari \u2014 and goes further: judicial authorities and government departments <em>may not consider any dispute or claim<\/em> relating to a lease contract unless the contract is registered. An unregistered tenancy is not merely a weaker case. It is a case the forum is not permitted to hear. Landlords who let a tenancy run informally, or who never renewed the registration, routinely discover this at the worst possible moment.<\/p>\n        <p>Assuming registration is in order and notice has been served, the forum is the <strong>Rental Disputes Center<\/strong> \u2014 the judicial body established under Decree No. 26 of 2013 to hear rental disputes in Dubai. It is not a division of the ordinary courts. It runs its own case registration, its own conciliation department, and its own Department of Law Enforcement, which is what actually carries out an eviction once one has been ordered. That last point is the one landlords most often miss, and it is the subject of the section further down this page on what you must not do.<\/p>\n        <div class=\"np-hbox\">\n          <strong>Before you do anything else:<\/strong> check that the tenancy contract is currently registered and that you hold the Ejari certificate. If it is not registered, registration is the first step, not the notice.
