law does not ban subletting. It bans subletting <em>without the landlord&#8217;s written consent<\/em> \u2014 and it makes that breach one of the few grounds on which a tenancy can be ended before it expires. Since 26 August 2026 a second law applies on top, bringing shared housing under a Dubai Municipality permit. The original tenant stays on the hook to the landlord under the head lease; the new occupier answers to the tenant. It is a common arrangement in Dubai, and it is entirely lawful when it is done properly. The trouble comes from how often it is done without the one thing the law requires.<\/p>\n        <p>The governing provision is <strong>Article 24 of Law No. 26 of 2007<\/strong>, which regulates the relationship between landlords and tenants in the Emirate of Dubai. Its wording is short and worth reading exactly as drafted: <em>&#8220;Unless otherwise agreed by the parties to the Lease Contract, the Tenant may not assign the use of or sub-lease the Real Property to third parties unless written consent of the Landlord is obtained.&#8221;<\/em><\/p>\n        <p>Two things follow. The first is that the default is prohibition \u2014 if your tenancy contract says nothing about subletting, you may not sublet. The second is the opening clause, <em>&#8220;unless otherwise agreed&#8221;<\/em>, which means the lease itself can change the default. A tenancy contract that expressly permits subletting is valid, and where it does, you are not required to go back and ask again. This is why the first step is always to read the contract you already signed rather than to ask a neighbour what is customary.<\/p>\n        <p>The article requires <strong>written<\/strong> consent. A verbal assurance, a friendly WhatsApp exchange or an agent&#8217;s say-so is not what the provision calls for. Two things follow from that wording. First, the default position is that you may not sublet. Second, the default can be changed by the lease itself, so a tenancy contract that expressly permits subletting is valid and you do not need to ask again. Verbal permission is not what the article requires, so consent should be recorded in writing and kept.<\/div>\n      <\/div>\n      <div class=\"sb-faq-item\">\n        <div class=\"sb-faq-q\" onclick=\"sbFaq(this)\">What happens if I sublet without the landlord\u2019s permission in Dubai?<span class=\"sb-faq-icon\">+<\/span><\/div>\n        <div class=\"sb-faq-a\">Subletting without written approval is an express ground for eviction before the tenancy expires. Article 25(1)(b) allows the landlord to seek eviction where the tenant sub-lets the property or any part of it without obtaining the landlord\u2019s written approval, and the eviction applies to the sub-tenant as well as the tenant. The sub-tenant is not left without a remedy: the same article preserves the sub-tenant\u2019s right to claim compensation from the tenant who sublet to them.
